“We”, “us” or “our” means XFactor Academy LLC, with its principal place of business located at 236 N Main St Ste 2 Dousman WI US 53118-9322.

2. ABOUT THIS PRIVACY POLICY

Your privacy is important to us, so we’ve developed this Privacy Policy, which explains how we collect, use, and disclose your personal information. We collect personal information when you use our website(s), mobile apps, and other online and offline products, services and experiences (collectively, the “Services”). Please take a moment to read through this Policy in its entirety.

3. WHAT PERSONAL INFORMATION WE COLLECT AND HOW WE COLLECT IT?

We collect personal information that you provide directly to us:

Contact information. If you sign up to receive our newsletter, emails, or text messages from us, we will collect your name, email address, mailing address, phone number, and any other information needed to contact you about the Services.

Payment information. To order products or services through the Services, you will need to provide us with payment information (like your bank account or credit card information). Please note that your financial information is collected and stored by a third party payment processing company. Use and storage of that information is governed by the third party payment processor’s applicable privacy policy.

Survey information. You may provide us with other personal information when you fill in a form, respond to our surveys or questionnaires, provide us with feedback, participate in promotions, or use other features of the Services.

Communications information. We may also collect other information during our communications with you, including information that you send to us when interacting with our customer service agents, or when you call us or send emails or text messages. This may include information about how you contacted us, your marketing preferences, and other information that you choose to share.

3A. XFACTOR IOS MOBILE APP

This section describes the information handled through the XFactor iOS mobile app. The app is a companion to existing XFactor accounts and connects to XFactor’s website and WordPress systems.

Mobile-app information we handle

Account information. We handle your name, email address or WordPress username, account identifier, account type and display name.

Athlete and training information. We handle linked athlete names and profile identifiers, booked sessions, scheduling and training-location details, coach notes, timeline messages, assigned workouts, workout instructions and workout-completion progress.

Authentication information. Your email address or username and password are transmitted securely to XFactor’s server to authenticate your account. The mobile app does not store your password. Access and refresh tokens are stored securely in the iPhone Keychain.

If you enable “Save username,” the email address or username used to sign in is stored locally on that device until you disable the option or remove the app.

The app sends the generic label “XFactor iOS” for login-session management. It does not collect or transmit the user’s personal device name, iPhone model, advertising identifier or another persistent device identifier.

XFactor’s server may process network-request information, such as an IP address, temporarily for security, abuse prevention and login-rate limiting.

How mobile-app information is used

We use mobile-app information to:

  • Authenticate and secure XFactor accounts.
  • Display linked athletes, booked sessions, coach communications and assigned workouts.
  • Save workout completion and synchronize progress with the XFactor website.
  • Process display-name changes and account-deletion requests.
  • Provide customer support and important service communications.
  • Detect misuse and maintain the security and reliability of the service.

Information transmitted by the mobile app is not used for third-party advertising, cross-app tracking or app analytics. The app does not contain advertising or third-party analytics SDKs.

Marketing messages associated with separate website registrations, purchases or marketing choices are governed by the general sections of this Privacy Policy and their opt-out provisions.

Information the mobile app does not request

The current mobile app does not request or collect:

  • Precise GPS or device location
  • Contacts or address-book information
  • Photos, camera access, microphone recordings or audio
  • HealthKit records or medical information
  • Payment-card or banking information
  • Advertising identifiers
  • Browsing or search history

Workout completion is treated as fitness information because it records progress through assigned exercises. The app does not access Apple Health or HealthKit.

Mobile-app sharing

XFactor may provide mobile-app information to hosting, information-technology, communication and security providers only as reasonably necessary to operate and protect the service. XFactor does not sell mobile-app personal information or share it with data brokers for advertising.

The Support screen may open Mail, Phone, Messages, Instagram or a web browser only after the user selects an action. Those external services operate under their own privacy terms.

Mobile-app retention and deletion

We retain account, athlete, session, coaching and workout information while the account is active and for as long as reasonably necessary to provide the service. Limited records may be retained when required for legal, financial, safety, fraud-prevention, dispute-resolution or enforcement purposes. Backup copies may remain until they expire through normal backup cycles.

Account deletion is available through Profile → Delete Account in the mobile app. Users may also contact XFactor for assistance. Account deletion may remove the account and its associated athlete, session and workout information, except information XFactor must retain for legal or legitimate business purposes.

Children’s information

XFactor services may include athlete information provided by parents, guardians or other authorized account holders. Parents and guardians may contact XFactor to request access to, correction of or deletion of a child’s information.

If we learn that personal information was collected from a child under 13 without appropriate authorization or any required parental consent, we will take reasonable steps to delete it.

Mobile-app privacy choices

Users may:

  • Update their display name through Profile → Edit Profile.
  • Change their account email through the XFactor website or by contacting support.
  • Disable “Save username” to remove the locally saved sign-in name.
  • Sign out to remove active login credentials from the app.
  • Delete their account through the app.
  • Unsubscribe from marketing email using its unsubscribe link or opt out of SMS marketing by replying STOP.

4. HOW WE USE YOUR PERSONAL INFORMATION?

We use the personal information we collect for the following reasons:

  • To send you our newsletter, or other information or marketing about our Services that you think may be of interest to you.
  • To reply to your questions, inquiries, or customer service requests or to send you notices, updates, security alerts, or support and administrative messages.
  • To provide you with information about the Services that you request from us or which we feel may interest you.
  • To monitor and analyze trends, usage and activities in connection with our Services and to improve the Services.
  • To facilitate contests, sweepstakes and promotions, and to process entries and provide prizes and rewards.
  • To detect, investigate and prevent fraudulent transactions and other illegal activities on the Services and to protect the rights and property of us and our customers.
  • To carry out our obligations arising from any contracts entered into between you and us, including for billing and collection.

7. YOUR MARKETING CHOICES

When you sign up for a promotion like a sweepstakes, or subscribe to receive our newsletter or marketing/promotional messages, we use your personal information to help us decide which products, services and offers may be of interest to you.

We will send marketing messages to you if you have asked us to send you information, bought goods or services from us, or if you provided us with your details when you entered a competition or registered for a promotion. If you opt out of receiving marketing messages, we may still send you non-promotional emails. Users of the XFactor iOS app can initiate account deletion through Profile → Delete Account. Users may also contact XFactor using the information below to request access, correction or deletion.

When you opt-in to the service, we will send you a message to confirm your signup.

By opting into messages, you agree to receive recurring automated marketing and informational text messages from XFactor Academy. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with XFactor Academy. XFactor Academy reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Cancellation

Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from XFactor Academy again, just sign up as you did the first time and XFactor Academy will start sending messages to you again.
